Landtasia Sale Terms

1. Orders and Prices

Your order submitted on the Landtasia website is an offer to purchase farm produce or other products specified on the order for the price set out there (plus any applicable charges).

As a result of the variability of custom meat processing, the exact weight of each portion of meat may vary plus/minus 10% from the typical weights set out in the order form or elsewhere on Landtasia’s website. The final invoiced price on some orders may differ from that which is listed there. You acknowledge that the final billing total may be varied accordingly. In any such event, you will only be charged for the exact weight of produce delivered to you, at the average per kilogram price stated.  Any shortfall from the typical weight will be refunded to you and any overage will be charged at the same per kilogram rate.

All prices are inclusive of GST.  Landtasia reserves the right to accept, reject or rescind any order.

Cancellation or Rescheduling Delivery Date: you may cancel or reschedule an order delivery date for up to 4 weeks provided the rescheduling occurs not less than 16 days before the original scheduled delivery date. If you cancel or reschedule with less than 16 days prior to original scheduled delivery date a surcharge payment of 12.5% will be applicable.

2. Payment

Payment shall be made in advance by designated credit card. By submitting your order, whether electronically of physically, you are authorising Landtasia to charge your selected credit card the designated amounts.

Landtasia will process your payment in full upon receiving your order if it is 15 days or less prior to the scheduled delivery date. Otherwise, Landtasia will process a 12.5% (twelve and one half percent) deposit payment at the time of order acceptance and the balance of the payment 15 days prior to the scheduled delivery date.  Details reflecting your purchase will be printed on the tax invoice included with your delivery.

If your credit card is declined by your financial institution, Landtasia will not be able to guarantee delivery on the date scheduled.

3. Delivery, Risk and Ownership

Your order will be delivered to the location agreed between you and Landtasia and either you or your nominee will need to take possession of the goods plus or minus two hours of the agreed delivery time on the scheduled delivery date. Once delivered it is your responsibility to see that the goods are inspected, promptly stored and adequately refrigerated.  Failure to do so can cause the produce to perish and be inedible.

Meat will only be handed over to you or a person at the delivery location signing for the produce on your behalf. It will not be left at a delivery location unattended. Delivery will be to the entrance of the delivery location and does not include unpacking or packing it into refrigeration.

If you are not present to take delivery at the confirmed delivery location, or delivery time and date, a re-delivery charge for each subsequent re-delivery attempt will result. Landtasia will append that to the original charge and payment method for the order.

4. Return and Refund Policy

If for any reason you are not satisfied that the goods you have purchased meet the specifications stated in Landtasia’s website or brochures at the time of order, you should call Landtasia Customer Support on 02-6238-0565 and a representative will assess your request for produce replacement or credit.

You acknowledge that you will inspect the condition of the goods at the time of delivery. Landtasia’s credit and refund policy is limited to a claim being lodged within 24 hours after delivery. You must freeze any item(s) that you claim doesn’t/don’t meet the specifications until it/they are collected by Landtasia’s delivery driver, who will exchange them for the refund payment or replacement produce.

5. Liability

Landtasia warrants that its produce will meet the characteristics described in Landtasia’s product information brochures or website. However, due to the nature of custom meat processing, Landtasia cannot guarantee that the proportion of cut yields will exactly match those set out on the order Form or website typical Cut Styles chart.

You agree that any liability in connection with a breach of any expressed or implied warranty or condition in respect of goods sold to you by Landtasia (other than a condition or warranty implied by legislation which does not permit liability to be limited as stated herein) will be limited to Landtasia’s Returns and Refunds policy stated in Section 4, above.

To the extent permitted by law, you release and discharge Landtasia and its related parties from all forms of direct, special, indirect or consequential loss or damage arising out of or in connection with these terms .

6. General

These terms and implied agreement shall be governed by the laws and courts of New South Wales.  They apply to sales by Landtasia Organic Farms Pty. Limited  ABN: 71-101-780-607 of 1000 Butmaroo Road, Bungendore, NSW 2621, ("Landtasia”).  Notices to Landtasia are to be sent to Landtasia, Attention General Manager.

You acknowledge that by submitting an order to Landtasia or accepting delivery of goods from Landtasia, you shall be deemed to have accepted these terms of sale.  Where there is an inconsistency between the terms of any customer purchase order or instructions and these terms, then the terms of this agreement will take precedence.

If a provision of these terms is invalid, illegal or unenforceable, then that provision to the extent of the invalidity, illegality or unenforceability must be ignored in the interpretation of this agreement; and all the other provisions of this agreement remain in full force and effect.

8. Privacy

Any personal information submitted by you when conducting business with Landtasia will be treated confidentially and only used by Landtasia for the purposes intended in this relationship. Landtasia will not provide, rent or sell your personal information to third parties.

Landtasia will only communicate with you via email or telephone regarding your order transactions, unless you otherwise specify in your customer profile other areas that you invite us to communicate with you. 

Landtasia may hold your personal and transaction information for a period up to seven years or as required by applicable law.
